Abstract

This text analyses the environmental dispute settlement mechanisms between states outlined in the Comprehensive and Progressive Agreement for TransPacific Partnership (CPTPP) within the context of International Law and International Environmental Law. The authors argue that the CPTPP aims to strike a balance between the environment and trade, recognizing the interconnected nature of ecosystems. The text explores preventive-collaborative instances and hybrid dispute resolution systems, highlighting cooperation over confrontation. The successful implementation of the CPTPP could generate positive synergies over a vast territory, despite inevitable tensions that may arise. Overall, the article emphasizes the importance of balancing trade and environmental concerns through collaborative and innovative dispute resolution mechanisms.
