From whom and how do health professionals obtain consent when the patient and their parents are under the age of 18?

This study will explore who consents to medical treatment when the patient and their parents are under the age of 18, and legally minors. This issue has not been directly addressed by the law but guidance from the Department of Health makes it clear that only parents with legal capacity can consent to their children being treated, but no advice is provided as to who health professionals should seek consent from if the parents do not have capacity. This study aims to discover what happens in practice when a patient and their parents are under the age of 18; from whom do health professionals seek consent? Is specific guidance on this issue required in order to protect health professionals, and patients and parents who are under 18? GPs and hospital consultants will be interviewed in order to determine how this matter is dealt with in practice.
