Abstract

Set within the inward approach section of this book, this chapter examines how the pursuit of a rescue objective is encouraged by the design and interpretation of the insolvency text that governs corporate rescue procedures. The selected procedures have been chosen on the basis that they allow different agents within the process to be examined; namely, directors and their input in the new standalone moratorium, the court-focused new restructuring plan, and the insolvency practitioner led administration process with the role of creditors also considered.
